Acceptance of Terms of Use
PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of WearTodayGoneTomorrow.com (this "Site") and Wear Today, Gone Tomorrow's service, rental and sale of products (this "Service") agree that access to and use of this Site are subject to the following terms and conditions and other applicable law. If you do not agree to these Terms and Conditions, please do not use this Site.
These Terms of Use are an ongoing binding legal contract between you and PAEP LLC d/b/a Wear Today, Gone Tomorrow ("we," "us," and "our"). These Terms of Use affect your rights and you should read them carefully.
Important Disclaimer
Wear Today, Gone Tomorrow selectively offers only the top brand names and finest quality designer items. We proudly stand behind the authenticity of our goods. In many instances, these items were purchased from reputable resellers or value-added resellers at a discount and were not obtained directly from the designers. In turn, this allows us to pass the savings onto you. Regarding this, Wear Today, Gone Tomorrow expressly disclaims any suggestion that it is an authorized dealer or agent of any of the designers whose goods are offered for rent or sale on this Site. While many of the products available for rent or sale at Wear Today, Gone Tomorrow are current season, many are not. Regarding this, Wear Today, Gone Tomorrow expressly disclaims any suggestion that all items available are from current season collections.
Wear Today, Gone Tomorrow does not sell any products for purchase by children without parental consent. However, we may sell products for use by children by purchase of adults. Wear Today, Gone Tomorrow is not directed to any under the age of 18. You must be 18 or older to become a member of and rent or purchase from Wear Today, Gone Tomorrow.
Changes to Terms of Use
These Terms of Use are subject to change by Wear Today, Gone Tomorrow at any time, in its sole and absolute discretion, with or without advance notice to you. The most current version of the Terms of Use can be viewed by clicking on the "Terms of Use" located on the bottom of the pages of the Wear Today, Gone Tomorrow website. The most current version will always supersede any previous version. Your use of our website or continued use of our service after changes are made means that you agree to be bound by these changes. As such, please read these Terms and Use periodically.

Wear Today, Gone Tomorrow's personal information practices on this Site are governed by our Privacy Policy. Please review this privacy statement and print a copy for your records.
Our Service
Wear Today, Gone Tomorrow is an online service which provides its members the ability to rent or purchase authentic designer clothing at significant discounts according to these Terms of Use. With free membership, members select designer clothing, receive them at their home via USPS and simply return them either by scheduling a pickup with USPS or by dropping it off at their local post office with prepaid return labels. Members rent for a one week period, for no charge other than the applicable rental and cleaning fee. If items are held in members possession past the one week time frame, we will subsequently charge a 5% of retail value daily late fee until the item has been postmarked by and is back in the US Postal Service's possession. Our membership plan allows members to rent as many articles of clothing as they choose, however, we reserve the right to limit the number of items any member can rent or purchase at one time, and to deny rental/purchasing rights at any time, for any reason we deem relevant. If you have the maximum number of Wear Today, Gone Tomorrow online rentals allowed checked out, no additional rentals will be shipped until you return one or more of the outstanding rentals. You may have only one Wear Today, Gone Tomorrow membership plan per email address at any one time. The Service is thoroughly outlined on the Site, as are shipping and return policies. Any and all items shipped will be either brand new or freshly organically dry-cleaned. While most orders will be shipped same day if payment is cleared by 2pm EST (and will be received within 2 - 3 business days), Wear Today, Gone Tomorrow makes no guarantee of same day shipment or of delivery date or time. Some factors that can contribute to delay in shipment or delivery include, but are not limited to: 1) availability of product, 2) cleared payment, 3) members' delivery address, 4) unanticipated downtime of our computer systems and 5) factors once in USPS' possession, including among other factors, inclement weather and/or heavier mailing times. Once we give our carrier the order, the risk of loss is passed onto the member. Wear Today, Gone Tomorrow will notify the member once the order has been shipped, and will charge the first week's rental fee at time of shipment. If items are held in members
possession past the one week time frame, we will subsequently charge a
5% of retail value daily late fee until the item has been postmarked by
and is back in the US Postal Service's possession. Members will not be charged for time the order is in the shipping carrier's possession. If it is postmarked by USPS and shipped back within seven days of receiving it, there will be no additional fees. We will send an email once return shipments are received.
There is a risk of loss during shipment for all items rented/purchased from Wear Today, Gone Tomorrow. We will deliver all items to our carrier, but this does not guarantee delivery to you. Please contact us if you do not receive your order.
We reserve the right to change the price, content or Terms of our Service at any time. We will not be held liable to you or any third party for any such changes to the Terms of Use.
Membership and Billing
Members can find specific details regarding membership with Wear Today, Gone Tomorrow anytime by clicking on the "My Account" link, located at the top of our website pages. You must be 18 years old or older to become a member of this Site.
To use the Service, you must register as a member through the site and set up an account providing us with your name, shipping address and e-mail address. By requesting membership with Wear Today, Gone Tomorrow and by accepting the benefits of the Service we provide, you agree to allow us to obtain credit information from a valid credit card that you are authorized to use and from consumer credit-reporting agencies at any time while you are a member. You can cancel your membership at any time by email or phone call to customer service. We reserve the right to suspend or terminate your membership at any time, at our sole and absolute discretion. You agree to provide and, if necessary, update wholly true, accurate, current and complete information about yourself at membership registration and when necessary at later times. Any such information provided or excluded that contradicts with this policy warrants suspension or termination of membership. It is your sole responsibility to maintain the confidentiality of your account and password.
Standard membership is free, however, you authorize Wear Today, Gone Tomorrow to bill your credit card for rental, purchase, cleaning and/or alteration fees, all taxes when in the state of New York, shipping fees and any additional charges you incur in connection with your account as stated. You will be charged if items are held in your
possession past the one week time frame. We will subsequently charge a
5% of retail value daily late fee until the item has been postmarked by
and is back in the US Postal Service's possession. You will not be provided with copies of charge slips evidencing the recurring charges of the applicable rental. You agree to pay the applicable fees (plus taxes) in accordance with your Payment Method issuer agreement, if applicable. You also authorize Wear Today, Gone Tomorrow to charge your payment method for any other charges you may incur associated with your Wear Today, Gone Tomorrow rentals and/or purchases. If we cannot collect payment from your credit card for any reason whatsoever, including expiration or over the card limits, payment is due immediately, and we reserve the right to obtain payment by any means necessary including but not limited to third-party collection agencies. If we find the credit card you provided is not pre-authorized to cover fees associated with the rental, we may deny rental at our sole and absolute discretion. If we notice we've under charged payment even at our own mistake, we reserve the right to correct such errors. It is your responsibility to pay all fees associated by your use of the Site charged by your credit card's issuer including, but not limited to over the limit, overdraft charges and insufficient funds. WTGT will not refund or credit any such fees charged to your account for any charge associated with your WTGT account. All dresses that have belts/sashes will be shipped with them, and it is your responsibility to return the belt/sash with the dress. Dress returns cannot be completed without matching belts/sashes. WTGT reserves the right to charge up to the full retail value for a dress that is returned without it's matching belt/sash as it is not rentable without all parts, is lost, or for which is damaged beyond repair. It is your responsibility to notify us of any billing errors within 60 days after they appear on your statement, otherwise you agree to waive your right to dispute them. You can only use one coupon per order.
VIP Membership
While standard membership is free and without commitment, customers may choose to upgrade to one of our VIP Membership Plans. By choosing to upgrade to the Platinum Membership Plan, you authorize Wear Today, Gone Tomorrow to charge the monthly membership fee of $49.95 to the credit card provided for the course of a one year contract duration. Platinum VIP Membership buys such members additional discounts. You will receive fifty dollars off the first order placed per month. All rental fees placed monthly will also be deducted by 50%. By choosing to upgrade to the Gold membership Plan, you authorize Wear Today, Gone Tomorrow to charge the monthly membership fee of $29.95 to the credit card provided for the course of the one year contract duration. Gold VIP Membership buys such members additional discounts. You will receive thirty dollars off the first order placed per month. All rental fees placed monthly will also be deducted by 30%. Wear Today, Gone Tomorrow reserves the right to terminate membership for any reason deemed necessary. VIP members authorize Wear Today, Gone
Tomorrow to bill your credit card for rental, purchase, cleaning and/or
alteration fees, all taxes when in the state of New York, shipping fees
and any additional charges incurred in connection with your account as
stated. You will be charged the discounted rate for the seven day rental period. Items led past the seven day rental period will be charged at a reduced 3% of retail value per day late fee. You
will not be provided with copies of charge slips evidencing the
recurring charges of the applicable rental. You agree to pay the
applicable fees (plus taxes) in accordance with your Payment Method
issuer agreement, if applicable. You also authorize Wear Today, Gone
Tomorrow to charge your payment method for any other charges you may
incur associated with your Wear Today, Gone Tomorrow rentals and/or
purchases. If we cannot collect payment from your credit card for any
reason whatsoever, including expiration or over the card limits,
payment is due immediately, and we reserve the right to obtain payment
by any means necessary including but not limited to third-party
collection agencies. If we find the credit card you provided is not
pre-authorized to cover fees associated with the rental, we may deny
rental at our sole and absolute discretion. If we notice we've under
charged payment even at our own mistake, we reserve the right to
correct such errors. It is your responsibility to pay all fees
associated by your use of the Site charged by your credit card's issuer
including, but not limited to over the limit and insufficient funds.
It is your responsibility to notify us of any billing errors within 60
days after they appear on your statement, otherwise you agree to waive
your right to dispute them.
Gift Certificates
We sell gift cards that can be used toward any Wear Today, Gone Tomorrow service. By purchasing one, you agree to pay the applicable charge via your credit card. Gift cards are non-refundable.
Colors
We have made every effort to display as accurately as possible the colors of our products that appear on the Site. We cannot guarantee that your computer monitor's display of any color will be accurate.
Cancellation and Returns
As long as you have no outstanding orders and rentals in your possession, you may cancel your membership to Wear Today, Gone Tomorrow at anytime. Failure to return rentals will result in your credit card being charged for up to the full retail price for such items minus the rental fee already collected by the renter's credit card. We will not send a reminder email regarding unreturned items prior to charging your credit card.
We reserve the right to suspend or terminate your account with us for any or no reason.
Rentals are returnable and rental/cleaning fees are refundable if the member notifies us of the issue, obtains a return authorization number, and returns the item(s) clearly marked with the return authorization on the packing slip and all packing information inside the box within one (1) day. Shipping costs are non-refundable. In the event of a return, shipping charges are deducted from the refund and may be higher but never lower than $10.00 for standard priority shipment, or $24.95 charge for the upgraded overnight shipping option (New York) and $29.95 (all other states), as we incur a loss when shipping. The full shipment charge that we are charged by the carrier for your shipment and return will be passed onto the member in the event of a return. To prevent fraud, we reserve the right to decline rental/cleaning refund if the item fails our 10 step visible and invisible return inspection and either appears to have been worn, smells worn, or has wearing dirt or damage markings. We cannot provide a refund without an return authorization # (RA#). If a member chooses to order more than one dress to try them on for the purpose of selecting one, we reserve the right to deduct $10.00 for the return with the RA to cover the second return's shipping and handling. Reserved orders that are removed from our stock will be charged a 15% restocking fee if canceled within seven days before scheduled shipment.
All purchases of items made in our "Sale" section are returnable and sale prices are refundable if the member notifies us of the issue, obtains a return authorization number, and returns the item(s) clearly marked with the return authorization on the packing slip and all packing information inside the box within one (1) day. Shipping costs are non-refundable. In the event of a return, we will deduct shipping charges from the refund which may be higher but never lower than $10.00 for standard priority shipping , or $24.95 for upgraded overnight delivery charge (New York) and $29.95 (all other states), as we incur a loss when shipping. All refunds are made to the Retail Payment Method used for the original rental/purchase. We reserve the right to suspend/terminate membership for customers who have made excessive returns.
Please note: We will not be able to provide a refund for a return without a return authorization number.
Use of Service
We reserve the right, at our sole and absolute discretion, to charge the renter's credit card and collect an alteration or replacement fee for any lost item or any item that is returned in a damaged or dirtied state that exceeds normal wear and tear. Fair alteration fees will be charged for repairable alterations. Replacement fees for lost or destroyed items will vary but will never be more than the product's retail price.

Typographical Errors
In the event that a Wear Today, Gone Tomorrow product is mistakenly listed at an incorrect price, Wear Today, Gone Tomorrow reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Wear Today, Gone Tomorrow reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Wear Today, Gone Tomorrow shall issue a credit to your credit card account in the amount of the incorrect price.
Term; Termination
These Terms and Conditions are applicable to you upon your accessing the Site and/or completing the registration or shopping process. These Terms and Conditions, or any part of them, may be terminated by Wear Today, Gone Tomorrow without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Governing Law

Harassment in any manner or form on the Site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Wear Today, Gone Tomorrow or other licensed employee, host, or representative, as well as other members or visitors on the Site is prohibited. This Service is available only to customers located in the United States of America. If you are outside of the United States of America, kindly refrain from using this Service. Wear Today, Gone Tomorrow makes no representation that the Service and any content or products offered on the Service and their copyrights, trademarks, patents, and licensing arrangements, are appropriate or available for use in locations other than the United States of America.
Official Sweepstakes Rules
1. Program Description / Eligibility: No
purchase necessary. This promotion is open only to legal residents of the 50
United States or the District of Columbia, 18 or older, who become free members of Wear Today, Gone Tomorrow. Employees of PAEP LLC,
their affiliates, subsidiaries, and any person working on the product,
project, or promotion, advertising and promotional agencies, and the
immediate family members of each are not eligible. Void where
prohibited by law. The promotion begins on May 1, 2009, and ends on July 31, 2009 ("Entry Period").
2. How to Enter: You will be automatically entered
into the sweepstakes drawing when you become a free member of Wear Today, Gone Tomorrow. The schedule is subject to change
at the sole discretion of Wear Today, Gone Tomorrow. On July 31, 2009, one winner will be selected in a random drawing
from eligible entries received to win a $250 Gift Card than can be used toward future rentals/purchases from the Site. Random drawings will be
from among all member entries received during the applicable entry period.
Non-winning entries from any drawing will be carried over into
potential future subsequent prize drawings to be announced. No responsibility is assumed by PAEP LLC for lost, late, or misdirected member entries or any computer,
online, telephone, or technical malfunctions that may occur. All
member entries become the property of PAEP LLC and will not be returned. Odds
of winning the prize depend on the number of eligible entries received.
Limit one prize per person, per calendar year. No substitution, transfer, or assignment of
prize permitted. All taxes, additional cleaning, alteration or replacement fees for lost or damaged products beyond normal wear are the sole responsibility of the
prize winners. Credit card information will be taken, but not charged for the first $250 charges, to have on file in the event fees exceed the $250 available on the card.
3. General Conditions: Entrants agree to abide by
